KwikMart Terms of Service
Effective Date: 9th October 2025
Welcome to KwikMart, South Africa’s first affiliate marketplace. By using our platform as a Vendor (Seller), Affiliate (Marketer), or Buyer (Customer), you agree to the following Terms of Service.
1. General Provisions
• KwikMart is a marketplace platform that connects vendors, affiliates, and buyers.
• All users must be South African residents or legally registered entities.
• All transactions occur in Rand (ZAR) via secure local payment gateways.
• KwikMart reserves the right to update these Terms. Users will be notified of major changes.
2. Vendors (Sellers)
Eligibility
• Vendors must provide accurate business and contact details.
• Vendors selling food, supplements, or regulated products must comply with South African laws.
Product Listings
• Vendors are responsible for accurate product descriptions, pricing, and images.
• Expired, unsafe, counterfeit, or fraudulent products are strictly prohibited.
• Food and supplements must include expiry dates, ingredient lists, allergen warnings, and safe packaging.
Fees & Commissions
• Vendors set affiliate commission rates.
• KwikMart charges a small transaction fee per sale.
• Payouts are made in Rand via EFT, PayFast, Ozow, or PayShap.
Refunds & Returns
• Vendors must honor valid refund requests as per the Refunds & Buyer Protection Policy.
• Food and supplements: refunds apply if products are expired, unsafe, or mislabeled.
• Vendors failing to comply may face account suspension or removal.
3. Affiliates (Marketers)
Eligibility
• Affiliates must provide accurate details and valid South African banking/payment information.
• Affiliates may not promote illegal or unsafe products.
Commissions & Payments
• Affiliates earn commissions per sale through their unique links.
• Commission rates are set by vendors.
• Payouts are made in Rand on scheduled dates.
• Commissions are reversed if a sale is refunded.
Promotion Rules
Affiliates must:
• Disclose affiliate relationships clearly.
• Avoid false, misleading, or spammy promotions.
• Respect vendor branding and copyright.
• Avoid prohibited content (hate speech, explicit content, unsafe advice).
Violations may result in suspension, forfeited earnings, or permanent bans.
4. Buyers (Customers)
Ordering & Payments
• Prices are displayed in Rand (ZAR).
• Payments are processed securely via local gateways.
• Orders are confirmed only after successful payment.
Refunds & Returns
• Digital products: refunds if faulty or not as described (within 7 days).
• Physical products: refunds if defective, expired, or not as described (within 14 days).
• Food products: refunds if expired, contaminated, unsafe, or incorrect. Opened items only refundable if unsafe.
• Health supplements: refunds if expired, mislabeled, or defective. Opened bottles refundable only if unsafe.
Refunds for “change of mind” are at the vendor’s discretion.
Responsibilities
• Buyers must provide accurate delivery details.
• Buyers must follow product instructions and storage requirements.
• Fraudulent refund claims are strictly prohibited.
5. Dispute Resolution
• KwikMart mediates disputes fairly between vendors, affiliates, and buyers.
• Final decisions rest with KwikMart to protect marketplace integrity.
6. Prohibited Actions (All Users)
Users may not:
• List or promote illegal, unsafe, or counterfeit products.
• Use fraudulent payment or banking details.
• Engage in abusive or harmful behavior.
• Manipulate reviews, commissions, or refunds.
7. Liability Disclaimer
• KwikMart is a platform and does not manufacture or own vendor products.
• Vendors are responsible for product safety and compliance with South African law.
• KwikMart ensures secure transactions but is not liable for misuse of products after delivery.
8. Termination of Accounts
KwikMart reserves the right to suspend or terminate accounts that:
• Violate these Terms.
• Engage in fraud, misrepresentation, or unsafe practices.
• Harm the reputation or trust of the platform.
9. Governing Law
These Terms are governed by the laws of South Africa. Disputes will be handled under South African jurisdiction.
10. Agreement
By using KwikMart, you confirm that you have read, understood, and agreed to these Terms of Service.
